HOME INFORMATION PACKS (HIPS)
Since December 2007 it is a legal requirement that before you
can market your home a Home Information Pack (HIP) must have
been commissioned. This applies to all residential properties
irrespective of size or value.
We at Kirklands have a very strong property team with many
years experience and with substantial local knowledge. This
experience has enabled us to develop the process of producing
HIPS so that we are able to prepare the same for you both
quickly and economically. A HIP can be prepared in just a few
days and often more cheaply and comprehensively than other
providers. This will enable your property to be marketed at the
earliest possible date. A further benefit that you will derive
if we prepare the HIP for you, is that you will have ownership
of the HIP and you will not therefore be tied to a particular
Agent for marketing your property.
The original plan was for HIPS to contain more information
than is now actually required but nevertheless there is still
quite a lot of documentation that is needed to be assembled. The
original intention was for a Home Condition Report to be
provided but that is not now the case.
The minimum requirements for a HIP are as follows:-
- An Index
- Energy Performance Certificate (EPC)
- A Sale Statement
- Evidence of Title
- A Local Search
- Replies to Standard Enquiries
- Drainage and Water Search
In addition with effect from the 1st June 2008 a Leasehold
property will require all of the above together with the
following:-
- A copy of the Lease
- Rules and Regulations of any Management Company
- Statements or Summaries of Service Charges
- Most recent requests for contributions to:-
- (a) Service Charge
- (b) Ground Rent
- (c) Buildings Insurance
- (d) Third Party Liability Insurance
- · Names and addresses of Lessor, Managing Agents or
other persons
- · Any amendments to Lease or Rules and Regulations
- · Section 20 Landlord and Tenant Act Notices and details
of any works
All of the above information and documentation is collated
and produced by us in a document properly indexed for ease of
reference. This is available both in electronic and paper form.

Looking after the Elderly
Lasting Powers of Attorneys
None of us know when we could become either physically or
mentally incapacitated. As we all get older it is extremely
important that we make provisions for all eventualities to try
and make life as easy as possible for those looking after us.
We can advise and assist you in the making and registering of
Lasting Powers of Attorneys. A Lasting Power of Attorney enables
you to appoint somebody you trust to act on your behalf in the
event that you are unable to deal with your finances or make
decisions about your personal care yourself. Should you become
incapacitated in any way your registered Attorney would be able
to carry on taking care of your finances and making decisions
about your day to day care.
Should you have the older Enduring Powers of Attorney already
in place, these are still valid and there is no requirement for
you to also make Lasting Powers of Attorneys with regards to
your finances. You may consider making a Lasting Power of
Attorney to deal with your personal welfare.
Court of Protection applications
In the event that you lose mental capacity and are unable to
make decisions yourself and you have not made Lasting Powers of
Attorney, we will assist your relatives with appointing a
Receiver to be able to deal with your affairs.
Living Wills (Advance directives)
If you have the older Enduring Power of Attorney an alternative
to making a personal welfare Lasting Power of Attorney would be
to make a Living Will. A Living Will gives you the choice to set
out any medical care issues that you feel strongly about, such
as not accepting a blood transfusion or choosing to not be
resuscitated. Living Wills are not legally binding but intended
to reflect your wishes in a medical situation. A Lasting Power
of Attorney carries more weight and is legally binding.
